Terms of Sale
These Terms and Conditions apply to purchases made through our website. Please read them carefully before placing an order.
1. About Us
The seller is CC Golborne Ltd, trading as ClearCycle (“we”, “us” or “our”).
Our business and contact details are:
CC Golbourne Ltd t/a ClearCycle, Gateway House, Styal Road, Manchester, M22 5WY
These Terms apply to sales made to consumers. They do not affect your statutory rights.
2. Our Products
We sell physical goods through our website.
Some of the products we sell may be customer returns, ex-display, graded, refurbished, clearance or otherwise not in brand-new retail condition.
The condition of an individual product, including any known faults, cosmetic damage, missing parts or other significant imperfections, will be stated in the product description where applicable.
Please read the product description and examine the photographs carefully before purchasing.
Where a particular fault, defect, mark, missing component or other condition has been clearly disclosed before purchase, that disclosed condition forms part of the description of the product.
Nothing in these Terms limits your statutory rights where goods are faulty, not as described or otherwise do not meet the requirements of applicable consumer law.
3. Product Images and Descriptions
We take reasonable care to describe products accurately.
Where photographs show the actual item being sold, they should be considered alongside the written product description when assessing its condition.
Colours and appearance may vary slightly depending on lighting, photography and the screen or device used to view the website.
Measurements and dimensions may be approximate unless expressly stated otherwise.
4. Prices and Payment
The price payable is the price displayed at checkout when you place your order.
Unless stated otherwise, prices shown to consumers include VAT where applicable.
Any delivery charges will be shown separately before you complete your purchase.
Payment is required at the time the order is placed. Orders are not confirmed until payment has been successfully authorised.
5. Order Acceptance
Submitting an order does not necessarily mean that we have accepted it.
A contract between you and us is formed when we accept your order.
We may decline or cancel an order before dispatch where, for example, the product is unavailable, there has been an obvious pricing or listing error, payment has not been authorised, or we are unable to fulfil the order.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled goods.
6. Availability
All products are subject to availability.
Because many of our products are individual, clearance or limited-stock items, replacement stock may not be available.
If an item becomes unavailable after you order it, we will contact you and refund any amount paid for that item where we cannot supply it.
7. Delivery
We currently deliver to UK mainland addresses only.
Available delivery services and charges are shown during checkout and may vary according to the product, size, weight and delivery address.
You are responsible for providing complete and accurate delivery information and for ensuring that the goods you order can reasonably be delivered to the intended location.
For large furniture and other bulky products, you should check relevant doorways, staircases, corridors, lifts and other access restrictions before ordering.
Delivery dates and estimates are provided in good faith. Where a delivery date is an estimate rather than an expressly agreed deadline, delays may occasionally occur.
Nothing in this section affects any rights you have under consumer law concerning late or failed delivery.
8. Collection
Where collection is offered at checkout, orders may be collected from our Golborne collection location.
Collection must be booked in advance using the booking facility provided following checkout. Please do not attend without a confirmed collection arrangement.
Unless otherwise agreed, collection should take place within 3–5 days of purchase.
You should bring sufficient assistance and a suitable vehicle for the goods being collected. Our team may refuse to load an item where we reasonably believe doing so would be unsafe or could damage the goods, vehicle or other property.
Risk in the goods passes to you when you, or someone acting on your behalf, takes possession of them.
9. Your Right to Cancel
For most goods purchased online, consumers have a statutory right to cancel the contract within 14 days of receiving the goods, subject to certain legal exceptions.
In addition, we offer a 30-day returns period for eligible products.
To exercise your right to return an item, you must contact us within 30 days of receiving it and tell us that you wish to return it.
Certain products may be excluded from cancellation or return where permitted by law, for example bespoke or personalised goods and certain sealed products once opened.
Your statutory rights are unaffected.
10. Change-of-Mind Returns
If you return an item because you have changed your mind, you are responsible for the cost of returning it to us unless we agree otherwise.
Goods must be returned with reasonable care and, where possible, with any accessories, components and packaging supplied with them.
You may inspect goods as you reasonably would in a shop. If you handle the goods beyond what is necessary to establish their nature, characteristics and functioning and this reduces their value, we may be entitled to make an appropriate deduction from the refund where permitted by law.
For large or bulky items, return transport can be expensive. We recommend considering the dimensions, access requirements and suitability of the product carefully before ordering.
11. Faulty or Incorrectly Described Goods
Your 30-day returns policy is separate from your statutory rights.
Goods must be of satisfactory quality, fit for any particular purpose made known to us where applicable, and as described, taking into account the condition and any faults or imperfections specifically disclosed before purchase.
If an item develops a fault, is materially different from its description, or has an undisclosed problem, please contact us as soon as possible.
Where goods do not conform to the contract, the remedies available to you will be those provided by applicable consumer law. Depending on the circumstances, these may include a refund, repair or replacement.
Where we are legally responsible for accepting the return of faulty or incorrectly described goods, we will bear reasonable return costs or make appropriate arrangements for their return.
A condition, cosmetic imperfection, fault or missing component that was clearly disclosed in the product description before purchase will not, by itself, make the product faulty or incorrectly described.
12. Refunds
Approved refunds will be made to the original payment method unless otherwise agreed or required by law.
For change-of-mind cancellations covered by your statutory cancellation rights, we will refund the amounts required by law, including applicable standard outbound delivery charges.
We are not required to refund any additional amount you chose to pay for an enhanced or more expensive delivery service beyond our standard delivery option.
We may withhold a refund until we have received the returned goods or you provide evidence that they have been sent back, where permitted by law.
Refunds will be processed within the applicable statutory timescales.
13. Failed Delivery and Incorrect Information
Please ensure that your delivery address, telephone number and other order information are accurate.
If delivery cannot be completed because incorrect information has been provided, nobody is available to accept delivery where required, or reasonable access has not been provided, additional delivery or redelivery charges may apply where legally permissible.
14. Large and Bulky Goods
Many of our products, particularly furniture, can be large and heavy.
It is your responsibility to check product dimensions and ensure that an item will fit through the access route and into its intended location.
Unless expressly included in the delivery service purchased, delivery does not include dismantling doors or furniture, altering property, removing windows, specialist lifting equipment or other extraordinary measures required to gain access.
15. Ownership and Risk
Risk in goods passes to you when the goods come into your physical possession, or into the possession of a person you have identified to take delivery on your behalf.
Ownership of the goods passes to you once we have received payment in full.
16. Our Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Where you purchase as a consumer, we supply products for private and domestic use. If you use products for commercial, business or resale purposes, different terms may apply.
17. Personal Information
We use personal information in accordance with our Privacy Policy.
Information may be shared with payment providers, delivery companies and other service providers where reasonably necessary to process and fulfil your order.
18. Events Outside Our Control
We will not be responsible for delay or failure caused by circumstances outside our reasonable control.
Where such circumstances materially affect our ability to fulfil your order, we will contact you as soon as reasonably practicable and your statutory rights will continue to apply.
19. Changes to These Terms
We may update these Terms from time to time.
The Terms applying to your purchase will normally be those in force when your order was placed.
20. Governing Law
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you will also retain any mandatory protections provided by the law applicable to you.
Any dispute may be brought before the courts having jurisdiction under applicable consumer law.
21. Contacting Us
If you have a question about an order, wish to cancel an order, arrange a return or report a problem with a product, please contact us using the contact details provided on our website.
